TERMS OF SERVICE & LIABILITY WAIVER

This agreement is between FLYT GOLF PTE. LTD. (“the Company”) and the person making the booking (“the User”). By completing a booking, you agree to the following terms:
- UNMANNED FACILITY & ACCESS
- 1.1 Autonomous Operation: The User acknowledges that the facility is unmanned and unsupervised. Use of the premises is at the User’s own risk. Immediate physical assistance or medical aid may not be available on-site.
- 1.2 Access Security: Access codes or digital keys are for the User’s personal use only. The User is strictly prohibited from sharing codes or allowing unauthorized individuals (“tailgating”) into the facility.
- 1.3 Surveillance: The premises are under 24/7 CCTV recorded surveillance. Footage will be used for security, damage assessment, and enforcement of these terms.
- 1.4 Emergency Protocols: First aid kits are accessible on-site. Because the facility operates autonomously, it is the User’s explicit responsibility to contact emergency services (995 for fire/ambulance, 999 for police) directly in the event of an emergency.
- ASSUMPTION OF RISK & LIABILITY WAIVER
- 2.1 Physical Risk: Golf involves inherent risks (e.g., being struck by clubs/balls, ricochets from the simulator screen). The User expressly assumes all risks of injury, illness, or death.
- 2.2 Release of Liability: To the maximum extent permitted by Singapore law, FLYT GOLF PTE. LTD. and its officers shall not be liable for any claims, damages, or injuries arising from the use of the facility, including those caused by equipment malfunction or the Company’s ordinary negligence.
- 2.3 Health Warranty: The User represents they are physically fit to participate in strenuous activity and have sought medical clearance if necessary.
- 2.4 Personal Property: The Company is not liable for any lost, stolen, or damaged personal belongings brought into or left at the facility at any time.
- FACILITY RULES & ETIQUETTE
- 3.1 Swing Safety: Users must hit only from the designated mats toward the screen. All other persons must remain behind the safety boundary/mat area while a swing is in progress.
- 3.2 Proper Footwear: For safety reasons and to protect the hitting mats, all Users are required to wear covered shoes at all times. Open-toed shoes, sandals, slippers, or bare feet are strictly prohibited within the hitting bays.
- 3.3 Minors: Individuals under the age of 16 must be supervised by an adult at all times. The adult assumes full responsibility for the minor’s safety and conduct.
- 3.4 Housekeeping: Users must leave the bay in a clean and tidy condition. All golf balls and equipment must be returned to their original positions. A cleaning fee of $100 may be charged for bays left in an unsatisfactory state.
- 3.5 Food, Beverages, & Alcohol: Food, beverages are permitted. However, the User assumes total financial responsibility for any spillage or resulting damage to the equipment, electronics, or premises. Alcohol is strictly prohibited to be consumed within the premises. Please refrain from bringing any durian-related products into the studio. A cleaning fee of $500 will apply for the consumption of durian within the premises.
- 3.6 Capacity & Conduct: While there is no strict capacity limit per bay, hosting disruptive events or parties is strictly prohibited. The Company reserves the right to terminate the session without a refund if the group causes a disturbance or violates safety guidelines.
- EQUIPMENT & PROPERTY DAMAGE
- 4.1 User Liability: The User is financially responsible for any damage to the Company’s property (including but not limited to: simulator screen and enclosure, launch monitor, sensors, camera, TV, PC and furniture) caused by negligent or reckless use. This includes damage resulting from food or beverage spills.
- 4.2 Reporting: Any pre-existing damage found upon entry must be reported immediately to the Company via the contact details provided on-site/online.
- BOOKING, CANCELLATION & REFUNDS
- 5.1 Payment: Full payment is required at the time of booking. All sales are final and non-refundable.
- 5.2 Rescheduling: Rescheduling is permitted up to 12 hours before the start of the booking. No-shows or late cancellations will result in the forfeiture of the booking fee.
- 5.3 Right to Terminate: The Company reserves the right to remotely revoke access or ban any User who violates safety rules, engages in illegal activity, or causes a disturbance, without a refund.
- 5.4 Technical Outages: In the event of a significant system failure, simulator crash, or hardware malfunction that prevents the use of the bay during a booked session, the User will be entitled to a full refund or booking credit.
- INDEMNIFICATION
- 6.1 The User agrees to indemnify and hold FLYT GOLF PTE. LTD. harmless against all claims, costs, and legal expenses arising from the User’s conduct or any injury caused by the User to a third party.
- DATA PRIVACY
- 7.1 PDPA Compliance: In accordance with the Personal Data Protection Act (PDPA), the Company collects and processes booking data and 24/7 CCTV surveillance footage solely for the purposes of facility security, damage assessment, dispute resolution, and enforcement of these terms.
- GOVERNING LAW
- 8.1 This Agreement is governed by the Laws of the Republic of Singapore. Any disputes shall be subject to the exclusive jurisdiction of the Singapore Courts.
